Terms of Service

Welcome to use Mainiox Oy's (hereinafter "Service Provider") SAAS software (hereinafter "Service"). Use of the service requires that you accept these terms of use (hereinafter "Terms of Use"). The acceptance of the terms of use takes place in connection with the acquisition of the right of use.

Service description

The service is cloud-based software that offers customers maintenance solutions. After the two-week trial period, you must place an order to use the service. The service includes Stripe payment integration.

Privacy policy

The service provider complies with all applicable EU laws and regulations. Our register statement contains all the necessary information about processing your personal data. More information about our register statement is on the Service's website.

Dues

The service is subscription-based and requires a paid subscription for its continuous use. The fee is charged automatically at the beginning of each subscription period. The payment includes all costs related to the use of the service. The prices are in euros, and VAT is not included.

Cancellations and returns

The customer has the right to cancel the order at any time. We do not refund fees paid by the end of the subscription period. The service provider can cancel the order without notice if the customer violates these Terms of Use.

Intellectual property rights

The service includes all intellectual property rights, including copyrights, trademarks, and patents. The customer does not have the right to use the content of the service for anything other than the use of the service. The customer has no right to change, copy, share, publish, or distribute the content of the service.

Limitation of liability

The Service Provider shall not be liable for any direct, indirect, special, or punitive damages resulting from using the Service or preventing its availability, including but not limited to loss of income, business interruption, loss of information, or reputation. The Service Provider is also not responsible for damages caused by the actions or omissions of the Service user.

The Service Provider's liability is limited to errors that occurred during the delivery of the Service, which are caused by the Service Provider's carelessness. The Service Provider's responsibility is limited to correcting errors or non-delivery of the Service. The service provider is not responsible for errors caused by the customer's operating environment or information system problems.

Information security

The Service Provider uses appropriate information security practices to protect the information security of the Service. However, the customer must understand that all data traffic online is exposed to data security risks, and the Service Provider cannot guarantee complete data security. Therefore, the customer must ensure that his hardware and software are properly protected.

The customer is responsible for ensuring its users store the identifiers carefully and do not disclose them to third parties.

The customer undertakes to notify the supplier immediately if the identifier comes into the knowledge of a third party or if he suspects misuse of the identifier. Using the software service with the customer's responsibility tags ceases when the supplier has responded to the customer's notification or the supplier has otherwise detected misuse.

Changes to the terms of use

The Service Provider can change these Terms of Use at any time. Changes take effect as soon as they are published on the Service's website. Therefore, the customer must check the Terms of Use regularly and continue using the Service only if he accepts the changes.

Instructions and operating environment

The supplier will provide other support or training related to commissioning only if it has been agreed upon separately. The supplier has the right to charge for implementation-related support and training.

Returning the customer's material

The supplier hands over the customer's material to the customer within 30 days of the customer's written request. The customer's material is handed over in a commonly used electronic format. The supplier has the right to charge for handing over the customer's material.

Applicable law and dispute resolution

Finnish law governs these Terms of Use, and we initially settle any disputes through negotiations. However, if negotiations fail to resolve the conflicts, we will resolve them in the Pori district court.
